SECTION 1 - OUR POLICY
Your personal data is data that identify you as an individual and PowerZ thanks you for trusting us to protect it. We constantly strive to earn the trust of our players and their parents or legal guardians. You retain control of your data and can manage how it is used in accordance with Section 5 below.
SECTION 2 - THE DATA WE COLLECT
In order to play the Game, users will need to create an Account. PowerZ will not collect more personal data than is reasonably necessary to ensure a technically stable and secure online Game experience.
When you create an Account and play the Game, PowerZ collects the following data:
• Player's email address
• Parent or legal guardian's email address, if applicable
• Purchase data/history
• Customer ID and other data, such as username and date of birth
• Account data, such as data in the Game, progress in the Game, achievements, time spent in the Game
• IP address and connection data
• Technical information about your device, including device identifiers and cookie data
SECTION 3 - WHAT DO WE USE THE DATA FOR?
PowerZ stores player personal data:
• To enable us to create your unique Account profile and use and share your Account details between different products and Services provided by PowerZ.
• To identify in which country the player is located and therefore the applicable laws and regulations.
• To determine the age of consent in the user's region, so that we can help the user obtain parental or guardian approval if necessary.
• To ensure that the player has the correct version of the Game for their country.
• To allow the player to access the Game, in order to progress and enjoy the best possible Game experience.
• Communicate with the player about their Account.
• Send news and updates via email, notification push or other methods, if the player so desires.
• Contact the player to send marketing offers via email, notification push or other methods, including marketing offers personalized to the player's profile and Game data, if the player so chooses or if the player's parents have opted in for their Account.
• To help us troubleshoot crashes and improve the functionality of the Game and our products and Services, as well as to customize the player's Game experience, record preferences, authenticate our users and provide similar user experience features.
• To help us detect and prevent abuse or fraud, to maintain fairness among all our users, and to protect and defend our users, products and Services.
• Allow us to measure and analyze how our products and Services are used for statistical and analytical purposes and for display, attribution and otherwise analyzing the effectiveness of our advertisements.
• Password Management.
PowerZ also collects anonymous player performance data in order to tailor in real time the difficulty in the Game to the player's level, using Artificial Intelligence.
PowerZ stores parent or guardian data to:
• Set up your payment method when you purchase a subscription.
• Enable future payment processing.
• Maintain your consent history.
• Store your billing address for future payments.
• Store your email address so we can contact you about your child's Account.
• Allow us to send you marketing offers, if you have agreed to receive them.
• Collect anonymous game performance data from Player Profiles of the Account.
We use cookies and similar technologies to (i) provide and maintain the functionality of our Services, (ii) measure and analyze how our Services are used, and (iii) measure the effectiveness of our advertising outside of the Game. Under the General Data Protection Regulation (GDPR), the legal basis for our processing of this information is as follows:
(a) We need the information to be able to perform the contract we have with you, including to provide our products and Services;
b) We need the information to comply with a legal obligation;
c) Your consent, where we have requested and obtained such consent; You may withdraw your consent at any time. Contact dpo@powerz.tech to do so.
d) We have a legitimate interest in processing the information for the business purposes described above, provided that our interest is not overridden by your right to privacy and protection of your personal data.
SECTION 4 - HOW LONG DO WE KEEP THE DATA?
The data we collect is stored for the time necessary to provide the Services requested by the user or for the purposes described in this document. The user may at any time request PowerZ to deactivate or delete the data.
SECTION 5 - HOW DO WE HANDLE YOUR DATA RIGHTS AT POWERZ?
You have rights regarding the respect of your data and you can assert them as outlined below.
5.1 CAN I CORRECT THE INFORMATION YOU HAVE ABOUT ME?
If you find that we have incorrect information about you, you can update and correct certain information under "My Account". If you find that you are unable to update your information, please contact our customer support team at dpo@powerz.tech.
5.2 CAN I WITHDRAW MY CONSENT AND LIMIT THE PROCESSING OF MY PERSONAL DATA?
If you decide that you no longer wish to have an Account with us, you can send a request to our customer support team at dpo@powerz.tech at any time.
As a registered player, you can withdraw your consent to the processing of your personal data at any time in your Account settings. You can also ask us to limit the processing of your personal data by sending a request to our customer support team at dpo@powerz.tech.
We will process most requests to withdraw consent, update or delete data and requests for information within 30 days.
5.3 CAN I REQUEST INFORMATION OR ASK FOR MY PERSONAL DATA TO BE DELETED?
As a registered player, you can request that your child's data as well as your own be deleted.
As a registered parent or legal guardian, you can request that your or your child's data be deleted. You can also request the removal of your payment methods. You can request the removal of your data by sending a request to our customer support team at dpo@powerz.tech.
For security reasons, we store and archive old data. This allows us to use it to investigate any complaints or violations of our Terms & Conditions or in case law enforcement and data protection authorities request it.
As a registered player, you can access most data under "My Account" or in the Game. Contact dpo@powerz.tech (see section 9 below for full contact details) for any additional requests for information regarding your personal data.
5.4 CAN I TRANSFER MY DATA?
Under the GDPR, PowerZ is considered a data controller. Under the law, you should be able to transfer your data to another data controller, if necessary. For PowerZ, this only applies to individuals who request it, as products and Services cannot be transferred to another company.
SECTION 6 - WITH WHOM WE SHARE YOUR INFORMATION
We may make personal and anonymous information available to third parties in these limited circumstances: (1) with third party service providers who help us operate our Website, Online Services and mobile applications, such as payment and data processing services, for a list of these third party service providers, visit https://www.powerz. com/service-providers, (2) with your express consent (or the prior consent of a parent or legal guardian), (3) when we believe it is required by law or when cooperating with law enforcement or other authorities, (4) when we believe it is necessary to protect our rights, users or property, or (5) for any potential successor or purchaser in connection with a merger, change of control, acquisition, liquidation, reorganization, bankruptcy, receivership, dissolution or sale of assets or the transition of the Services to a new provider, as required by law and/or contract.
SECTION 7 - HOW DO WE PROTECT YOUR INFORMATION?
At PowerZ, we have the utmost respect for the information you entrust to us and take pride in protecting it from unauthorized access or disclosure. Therefore, we have updated both administrative routines, are constantly working to train our employees on data protection, and are constantly updating and improving our electronic solutions to protect your data. This includes the use of Secure Sockets Layer (SSL) software, which encrypts all personal information you provide to us, as well as storing your information behind a firewall designed to block access to our network from the outside. However, while we will always do our best to protect your data, no security or encryption method can be considered completely safe in terms of protecting your information from hackers or human error.
The information we collect may be stored or processed on computers located in any country where we operate.
SECTION 8 - INFORMATION COLLECTED FROM CHILDREN.
Children and their parents residing in the United States have the same rights as our users in the EU that are described in this Privacy Policy.
Parents must consent for their child to use PowerZ.
When a child creates a PowerZ Account, we collect:
• Date of birth
• Email address
When a child plays our Game, we may also collect:
• Account-related data, such as data in the Game, progress in the Game, achievements, time spent playing the Game, and in-game communications.
• IP address and connection data.
• Technical information about your device, including device identifiers and cookie data.
The data we collect is stored for the time necessary to provide the Services requested by the user or for the purposes described in this document. The user may at any time request PowerZ to deactivate or delete the data.
As a registered parent or legal guardian, you may request to review or delete your child’s data as well as your own by contacting us at dpo@powerz.tech.
